north on to 395 where traffic actually seems to be moving pretty well until you get to duke street. that's when you're below the speed limit. that's going to continue towards seminary road before the pace improves. let's go back over to our maps this time over to southern maryland route 5, route 4, 301, everything up toward andrews air force base from brandywine and toward oxon hill and the wilson bridge. everything is fine there, all lanes are open. we'll take a live look at the american legion bridge on the west side of town. no issues to report leaving 270 towards tysons corner across the river. i'll be back with more traffic at 6:11. back to you guys. testimony in the trial of two college park police officers could wrap up later today. they're accused of beating a man they were taking into custody in march 2010. that's when the post-game celebration of a maryland basketball victory over duke got out of hand. 9news now reporter kristin fisher is live at that scene along route 1. good morning, kristin. >> reporter: good morning. these two officers are still facing two other charges,

second degree assault and misconduct in office. but that first degree assault charge has been dropped because the judge says that the student's injuries simply were not severe enough to warrant such a severe charge, that first degree charge. it's been dropped. two other charges remain. yesterday in court the judge essentially said that prosecutors had not presented enough evidence to prove what needs to be proved in the state of maryland to get that first degree assault charge which is that someone has caused or attempted to cause serious injury. prosecutors clearly disagreed with the judge's decision. they say the student here, john mckenna, had a concussion. and they also say, you know, who knows what the long-term effects might be. but officer baker, one of the defendants, told jurors yesterday that he never hit mckenna intentionally in the head and that he was only trying to get him to open his hands because he didn't know what might be inside of them. remember that this is all going on in the midst of what police

were characterizing as a riot in the middle of route 1 right after that duke-maryland game in 2010. although students say they were simply celebrating, there was no riot. that's been a discrepancy from day one. officer baker also told jurors take he never even realized that his codefendant officer harrison was standing next to him striking mckenna while the whole thing was happening. so we are waiting if officer harrison who -- for officer harrison who is expected to take the stand later today. his testimony should take up a lot of the court proceedings today and then tomorrow we are expected that the jury will get the case and they should begin deliberations around friday afternoon. back to you. >> kristin particularrer live from college park, -- fisher live from college park, maryland. a search is under way for a hit-and-run driver. montgomery county police say a black pickup truck hit a woman on university boulevard near east wayne avenue. her injuries are not believed to be life-threatening, how,

the victim is elderly -- however, the victim is elderly and did hit her head. she was crossing outside the crosswalk when she was hit. then other cars collided with each other to avoid hitting her a second time. two virginia patients who got meningitis after receiving steroid injections have now filed lawsuits asking for $15 million in damages. 19 people have now died in the outbreak, including two in virginia and one in maryland. dozens more in the mid-atlantic region have gotten sick from this. the outbreak has been tied to steroid shots that were used for back pain. most have a rare fungal form of meningitis. a specialty pharmacy in massachusetts made this steroid. federal officials are now investigating this case. federal agents arrested a 21-year-old man charging that he plotted to blow up the term reserve in new york city. officials say quazi nafis was arrested yesterday morning after a sting operation. he pack adavan with what he

thought were ex-- packed a van with what he thought were explosives and tried to detonate it from inside a hotel room. that was fake. he's being held without bail. in campaign 2012, president obama and mitt romney retreated to their respective corners ever the election ring. romney promised supporters in virginia he plans to win the swing state. >> i think it's interesting with two presidential debates gone, the president still hasn't found an agenda for his second term. we have an agenda and our agenda will get this country working again. >> it was part of an effort to chip aware at northern virginia which leans strongly toward barack obama in -- leaned strongly toward barack obama in 2008. >> governor romney continues to run around talking about his five-point plan for the economy. wait, wait, wait. don't boo. vote. >> president obama also listed

highs low 70s. tonight showers and storms will be arriving. just got word of an accident on the southbound side of 295 after eastern avenue. the left lane is blocked with police on the scene. here in college park, though, traffic is moving well in prince george's county. i'll be back with more traffic coming up at 6:18. it's 6:12. here's a check of what's making news now. the family of former senator george mcgovern says he's on life support and is no longer responsive and nearing the end. the 1972 democratic presidential nominee lost in a landslide to richard nixon. george mcgovern is 90 years old. a florida judge has set june 10 as the trial date for george zimmerman. he's charged with second-degree murder in the february shooting of unarmed teenager trayvon martin. zimmerman is claiming self- defense. nike, anheuser-busch and 24- hour fitness have all severed ties with famed cyclist lance armstrong after a report detailing doping use.

so i think the implications in that regard will be minimal. but some of those storms could be on the strong side, maybe severe even. we have a slight risk of that. we start with the bus stop forecast speaking of the bus, mike. the bus stop forecast. get you mobile on this thursday morning. temperatures in the 40s and 50s. you'll need to grab a jacket out there. it's dry. clear to partly cloudy. a patch of fog in frederick and culpeper. visibility in frederick still a quarter mile. culpeper has increased from half to one. stafford down to a mile and a quarter. we'll have to watch these areas generally north and west of town for the isolated areas of the patchy dense fog. day planner, we're looking good for the first three-quarters of the day. sunny at noon, 67. by 3:00 70. clouds increasing. by 6:00 we could seen have a shower around here with -- we could even have a shower around here. manassas down to 43.

bowie 47. laurel 50 degrees. it's 52 in upper marlboro this morning and 57 in great falls, virginia. if you've never been to great falls park in virginia, that's a cool place to check out. 55 on our camera. good visibility under moon lit skies with a south wind at 9 and humidity 83%. we've got the clear skies here. out to the west, look at the showers and storms from michigan and wisconsin. this goes all the way back to louisiana. some of these storms are weakening here in eastern kentucky and tennessee. i expect another round or another line of storms to be forming later today. that is what's going to be approaching us as we get into the nighttime hours. in fact, we even have a threat of those storms being severe with damaging wind gusts being the main concern across west virginia and the entire wusa viewing area up to baltimore, the eastern shore, really late today and tonight. i think for us the brunt of this will be falling after dark because we're just starting to see a few showers by 6:00. here comes the rain tonight into the overnight period.

the forecast today pretty decent, 72. late today, tonight, the showers and storms move in. we'll be in the 50s tonight with some 40s north and west. 73 tomorrow. maybe an early shower south and east. saturday and sunday look nice and cool, mid 60s. then warmer monday, tuesday, wednesday, back in the 70s. it's 6:18. here comes monika with timesaver traffic. thank you so much. on the inner loop of the beltway right after the dulles toll road, you want to watch out for a dear struck on the beltway. inner loop after the dulles toll road. all the activity is on the left shoulder but watch out for it. stay to the right to get around it. northbound 95 has been incident free. just the slow stuff as you can see behind me here as you come up from quantico. once you get into triangle looks like it's okay. woodbridge it's going to be slow across the occoquan river. let's take a live look in springfield on the northbound side of 95. as usual it's always heavy here route 644 to the beltway but it's incident free. let's go back over to the maps. there is an accident southbound 295 right after eastern avenue. that's going to slow you down

the save. there's more -- the n.f.l. season is more than a third over but the redskins play the first of their six divisional games this sunday in new york against the giants. the reigning super bowl champs. new york's defensive players and coaches are ak following they'll have -- acknowledging they'll have their hands full with the washington offense and rg3. even mike shanahan is getting used to what the redskins can go. >> it's a growing experience. it's fun to deal with a guy like robert because he can do so many things and picks up things so quickly. >> while the redskins are at 500 on the season with a 3-3 record, the giants come into sunday's game just a little bit better at a 4-2 mark. swra v.a. isn't just a -- virginia isn't just a swing state for the presidency. it's also a race for the senate seat. it's 6:24. here's monika. >> there's been a deer struck on the inner loop of the beltway after the dulles toll road along the left side.

thank you for starting your thursday with us. good morning. i'm andrea roane. i'm mike hydeck. howard bernstein is not here. that means he's out on the weather terrace this morning checking the conditions outside. good morning. good morning. not too bad. we're in the 50s in northwest d.c. light winds. that's going to change later when the winds are really going to pick up. we'll be in the 70s. we're looking east out of tysons corner this morning just starting to get some of that grow in the eastern horizon. sunrise not until 7:21. we have a ways to go still but it's going to be a nice sunny start. 67 by lunch time. clouds increasing this afternoon. there could be a shower by the mid- to late part of the evening commute or afternoon commute with a high of 72 and a 5:00 p.m. temperature of 70. this morning clear skies here with some clouds well to our west. expect a few of those to be arriving later on with the showers and the moisture increasing as well. 59 in annapolis this morning. that's our warm spot. frederick is 41. culpeper now down to 39 with patchy dense fog in the neighborhood there.

la plata 52. it's going to be a breezy, mild afternoon. 72 in d.c. 68 winchester. watch out late today and tonight as showers and maybe some strong thunderstorms rumble across the area. full seven-day forecast in a few minutes. right now here's monika. she's got the latest on timesaver traffic. howard, in d.c. on the westbound side of m street after connecticut avenue, you want to watch out for the accident. that one just reported. good morning, everybody. northbound 95 incident free this morning i'm happy to say. it's just that slow traffic as you try to head northbound toward triangle. we'll take a live look at 395 northbound. a minor instead on the shoulder in the hov lanes north of duke street. not affecting traffic at all. northbound 395 in the main lanes is slowing down duke to seminary road. back over to the maps, an accident southbound 295 after eastern avenue sits on the shoulder. a bit of slow traffic getting by. let's take a live look at 270. southbound delays off and on now 85 toward route 121. i'll be back with more traffic at 6:43.

back to you, andrea and mike. cbs news is learning much more about the foiled terror plot in new york city. >> that's one of the stories charlie rose and the team at cbs this morning is working on. charlie joins us live now from new york city. good morning, charlie. >> good morning, mike and andrea. we're gathering new information about the bold plot. the suspect is a 21-year-old man who arrived from bangladesh ten months ago. right now investigators are trying to figure out if he's a lone wolf or connected to a larger terror network. senior correspondent john miller is gathering new information from his sources inside the investigation. we'll see you at 7:00. >> charlie, we'll be watching. thank you. their trial isn't over yet but two college park police officers can breathe just a little easier this morning. >> that's because the most serious charge they were facing in an altercation with a maryland student has now been dropped. 9news now reporter kristin fisher is live in college park with the story this morning. kristin, good morning. >> reporter: good morning. officer james harrison is going to be taking the stand when court resumes a little bit

later today. his codefendant officer reginald baker testified yesterday. he said the reason that he hit this student, then 21-year-old john mckenna was because mckenna had approached the officers with his fists clenched. officer baker said that he asked mckenna to open his hand. he was worried about what might be inside. but when mckenna refused and did not open his hand, that is when officer baker says he took action hitting him several times with his baton which was all caught on tape and shown in court. this all went down after the duke-maryland basketball game in march 2010. they say they were celebrating but police say they were rioting. 33 people were arrested in total including mckenna although charges were later dropped. mckenna, the student involved in this trial, because of those two officers' actions, he

suffer add mild concussion but that's about it. for that reason the judge dropped the first degree assault charge. he said the prosecution had not presented enough evidence to prove that the student's injuries were serious enough to warrant such a serious first degree assault charge. now, these two officers on trial today are still facing two other charges, second degree sought and misconduct in office -- assault and misconduct in office. the jury will get the case tomorrow. officer harrison will be taking the stand. >> kristin fisher reporting live in college park this morning. thanks, kristin. fairfax county police are investigating an overnight collision on route 1 not far from huntington avenue. police say a pedestrian was hit around 2:00 this morning, was taken to a local hospital. they later died there. no word if it's a man or woman or the identity at this point. the driver stayed on the scene

and tried to help police in the investigation. the northbound lanes at huntington avenue were shut down for a while but they did reopen in time for the rush hour this morning. in local campaign 2012 news, former virginia governors george allen and tim kaine will duke it out in their fifth and final debate before election day. both men are vying for the seat held by retiring democratic senator james webb. the hour long debate starts tonight at 7:00 and virginia tech -- at virginia tech in blacksburg. we'll be streaming it live on our website wusa9.com. and in maryland there will be a debate tonight for the sixth congressional district race. incumbent congressman ross company bartlet and democratic challenger john delaney will go head to head. that's what happened at hagerstown community college in the keppler auditorium at 7:00 p.m. it's coming unon 6:35. -- up on 6:35. jessica doyle is back. >> she's watching your money and student loan debt. >> college seniors are looking at the situation where they're

saying college student loan piling up at record levels. you can blame rising tuition and a tough job market for the bump in student loan debt among new grads. last year the average college student graduated with nearly $27,000 in outstanding loans. that's up 5% from the year before. the institute for college access and success projects says tuition fees, the availability of financial aid and the cost of living all factoring into the amount of debt that students are piling up. you have to move fast if you want to cash in on a hot social media trend. and this one has the domain name binders full of women.com. was snapped up in less than two minutes after the phrase was uttered by mitt romney during the debate on tuesday night. governor romney said when he was looking to fill cabinet posts in massachusetts, his staff brought him binders full of women qualified for the job. of course the phrase went viral instantly. the speed rays won by american bridge 21st century.

it is 6:41 and 55 degrees. timesaver traffic. generally speaking we've got all this red and yellow around town. it's just the slow traffic and a couple of small incidents. one westbound at m street. on the inbound of 66, you see

the yellow. it's just slow, normal stuff as you travel in manassas into centreville and off and on into fairfax and vienna, that length there. as long as the lanes are open and you can make it to work, i think that's okay. let's take a live look at the northbound side of 395 where you've got the brake lights beginning at duke street. this is continuous to seminary road. once you're at the 14th street bridge, all the lanes are open and it looks good. this time to the other side. no problems on 95 coming in from baltimore, route 32, 29 in from columbia and the bw parkway as you travel into greenbelt is fine. we'll take a look at the beltway near colesville road. slow traffic off and on leaving 95 through silver spring. 270 southbound also very heavy from 85 past 109 most of the way to 121. still looks good in germantown and rockville. no issues on the west side of town at the american legion bridge as you travel toward tysons corner. i'll be back with more traffic at 6:58. back to you guys. right now we're seeing the jefferson memorial pretty dark out there.

but really dry. that's a good thing. howard is going to be teaming us in just a few -- telling us in just a few minutes we need to prepare for for forecasts. >> first half the day will be okay. as we head into the evening hours, possibly your evening commute or later howard says the rain is going to move in. >> i think around the metro we're probably safe through the late afternoon and probably not even going to see the worst of it till even after the evening commute is over. but we're still going to be watching this because we have the threat believe it or not for some nighttime october severe storms because the upper level dynamics are such and the timing it is going to be after dark in my opinion. we start fine. it's clear to partly cloudy, a touch of fog in frederick. it's a cool morning, especially in the outer suburbs with low to mid-40s. many of us in town are in the 50s already heading up into the low 70s. that fog an issue as i said in frederick at a quarter mile visibility. we've seen it get much better up in the culpeper area. they've gone from about half a mile to three-mile visibility. everybody else is looking

pretty good. check out our michael & son weather camera as we look toward the east. nice looking sky this morning with temperatures which will be rising into the upper 60s. the upper 60s as we go into the noon hour and then this afternoon we've got highs in the low 70s. about 70 for the drive home. it's 48 in gaithersburg. 52 hagerstown. winchester 50. 44 tappahannock. we had some fog but the cool spot right now culpeper 41 degrees. again a pretty sky out there with a temperature at reagan national of 55. wind south at 9 miles an hour. humidity at 83%. and the barometer 29.95 miles an hour. showers and storms across the deep south this morning. you can see this line coming up here through the deep south all the way to the midwest this morning. big storm system spinning here. that's bringing in some cool air to the northern plains. for us it will bring us the threat for some showers and storms and will bring us some rain tonight mainly.

out walk to stop diabetes on saturday. this morning i'm joined by warren brown, founder and owner of cake love to talk about how this disease affected both his family and his work. thank you so much for joining us this morning. appreciate it very much. >> glad to be here. >> first let me talk about your success. you're a lawyer turned baker and now you have six stores. >> that's right. cake love has been operating ten years. we bake cakes from scratch. people come in and share their stories with us and what they like. we were at taste of d.c. a couple of weeks ago. people love the caramel and cupcakes. >> i have such a sweet tooth. i'm so excited to try this stuff here. before we get to that, i know you had a very sad story about a year ago that happened in your family. tell us about that. >> my father passed away from complications related to type ii diabetes. >> i'm just going to fix your

mike. >>it's been a difficult year in the 12 months since he died. we celebrated his life and i think of him very often but, you know, diabetes was something that i was very unprepared for him to come down with. he's a physician. he was very antisugar. he was very into health and consciousness. but it's about diet and it's about exercise. >> it is. >> he didn't cook. a lot of the times when he would eat, it was going for the easiest, fastest thing and it wasn't necessarily nutritious food. >> you decided to become a baker and he wasn't into sugar. but you came up with something that at least take a lot of diabetics come into the store and want something they can eat too. we all have a sweet tooth. what is it that you put in these cupcakes and cakes? >> we developed a low guy seemic index cupcake and cake using a sugar walled wheylo. it looks like regular sugar and behaves like regular sugar in

terms of baking. that's what's great about it. it's not really a lot of thought you have to put into it. it's called whey low. >> it doesn't negatively impact your body so it doesn't give you a lot of gas like a lot of sugar substitutes do. so it's great. we have cupcakes that we do with it and strawberries and cream cakes. >> that doesn't mean if i'm a diabetic i can have two. >> you shouldn't. you've got to be in moderation with the food. all the different types of food. the american diabetes association doesn't tell people to not eat sugar. it recognizes that people can and do. you have to count your calories. this has lower calories which is an important part about managing your blood sugar. >> what are the flavors? >> we keep is real simple because you have to make sure you limit your calories. we do the vanilla bean or butter creep. sometimes people want
